Terms of Service

These terms are an agreement between you and FOP Danylchenko Daniil Serhiyovich, a private entrepreneur in Ukraine trading as Citrus ("we", "us"), of 7/1 Panasa Myrnoho st, Khmelnytskyi, 29017, Ukraine. They apply to your use of the mobile game Purrheaven ("the game"). By playing the game you agree to them. If you do not agree, please do not play.

1. Who can play

You must be at least 13, or the age of digital consent in your country if that is higher.

2. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to download and play the game on devices you own or control, for your own non-commercial entertainment. The terms of the app store you downloaded the game from also apply.

3. Your account

The game creates an anonymous account for you automatically. Your progress is saved on your device and backed up to the cloud under that account. Until sign-in with Apple or Google is available, the backup cannot be moved to a new account: if you uninstall the game, clear its data or lose the device, your progress may be lost and we may not be able to restore it. You can delete your account at any time — seeDelete your account.

4. Virtual items

Coins, gems, energy, items and other in-game content are licensed to you, not sold. They have no monetary value and cannot be exchanged for real money. We may change, rebalance or remove them as the game evolves. The game currently offers no purchases for real money. If that changes, we will update these terms first.

5. Fair play

Do not cheat, modify the game or its save files, exploit bugs, reverse engineer the game (except where the law allows it), or use the game for anything unlawful.

6. Suspension and termination

We may reset progress or suspend or close accounts that break these terms, in proportion to the breach. Where we reasonably can, we will tell you why, and you can contact us to dispute it. You can stop playing at any time by deleting your account and the game. These terms then end, except for the parts meant to continue, such as sections 7, 9 and 10.

7. Ownership

The game and all its content, including art, music, text and code, belong to us or our licensors and are protected by law.

8. Changes and availability

We may update the game, change features, or stop offering it. We may update these terms; the date above shows the latest version. If a change significantly affects you, we will tell you in the game beforehand. If you continue to play after a change takes effect, you accept it. If you do not accept it, stop playing and delete your account.

9. Disclaimer and liability

To the extent the law allows, the game is provided "as is" and "as available", without warranties of any kind, and we are not liable for indirect or consequential losses, or for loss of game progress.

To the extent the law allows, our total liability to you is limited to the greater of €50 and the amount you paid us in the 12 months before your claim.

Nothing in these terms limits or excludes liability that cannot legally be limited, such as for fraud, intentional harm, gross negligence, or death or personal injury caused by negligence, or rights you have under consumer law that cannot be waived.

10. Governing law and disputes

These terms are governed by the laws of Ukraine, and disputes go to the courts of Ukraine. If you live in the EEA, the UK or another country with mandatory consumer protections, you keep those protections and can also bring a claim in the courts where you live. Please contact us first, as most problems can be solved quickly.

11. Apple App Store

If you downloaded the game from the App Store, these terms are between you and us, not Apple, and we alone are responsible for the game and its content. Your licence covers Apple-branded devices you own or control, as the App Store's usage rules allow. Apple has no obligation to provide maintenance or support. If the game fails to meet an applicable warranty, you may notify Apple, which will refund any purchase price, and Apple has no other warranty obligation for it. We, not Apple, are responsible for claims about the game, including product liability, legal compliance, consumer protection, privacy and intellectual property infringement. You confirm that you are not in a country under a US government embargo or designated as "terrorist supporting", and not on a US government list of prohibited or restricted parties. You must also follow any third-party terms that apply when you use the game. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
